Updated: Apr 13, 2026 THIS TERMS OF USE AGREEMENT ("Agreement" or "Terms") is a legally binding contract between FeedingBird LLC, a for-profit corporation ("FeedingBird," "we," "us," or "our"), and any individual or entity accessing or using the Site or Services ("User," "you," or "your"). By accessing, visiting, downloading, registering for, or otherwise using www.FeedingBird.com, any subdomain, application, platform, dashboard, software, or any other service offered by FeedingBird (collectively, the "Site" and "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. You further acknowledge that you are at least eighteen (18) years old, possess full legal capacity to enter into this Agreement, and understand that your use of the Services constitutes full acceptance of all terms and conditions stated herein. If you do not agree to these Terms, you must not access or use the Site or Services.
1.1 Technology Platform Only. FeedingBird provides a technology-enabled, self-guided platform designed to assist Users in organizing, generating, and managing estate-planning documents and related information. The Services may include automated document assembly, templates, workflows, educational content, data upload tools, dashboards, analytics, and secure storage functionality. 1.2 Not a Law Firm. FeedingBird is not a law firm, and none of its representatives, employees, contractors, or staff act as attorneys. Your use of the Services does not create an attorney-client relationship with FeedingBird or with any individual associated with FeedingBird. 1.3 No Legal Advice. All information, templates, explanations, and outputs produced through the Services are intended for informational and self-help purposes only and do not constitute legal advice. FeedingBird does not provide legal opinions, legal recommendations, legal interpretation, or legal representation. FeedingBird does not review submissions or documents for legal sufficiency, accuracy, completeness, enforceability, compliance, or appropriateness for your specific circumstances. You are solely responsible for determining whether any document or output generated through the Services meets your legal needs and complies with applicable laws. 1.4 Recommendation to Seek Counsel. Estate planning is inherently complex, fact-dependent, and subject to variations in state law. FeedingBird strongly recommends that users consult a licensed attorney in their jurisdiction for advice tailored to their specific situation.
2.1 Incorporation by Reference. Your access to and use of the Site and Services are subject to FeedingBird's Privacy Policy, which is made available as a separate document on the website and is hereby expressly incorporated into this Agreement by reference. The Privacy Policy governs in full with respect to FeedingBird's data collection, use, storage, processing, and disclosure practices. By accessing or using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by the Privacy Policy in its entirety. 2.2 Accuracy of Information. You agree to provide accurate, complete, and current information when creating an account or submitting information through the Services, and you agree to promptly update such information as necessary. 2.3 Account Security. You are solely responsible for maintaining the confidentiality of your account credentials, including usernames, passwords, and authentication mechanisms. You agree not to share your credentials with any unauthorized person and to notify FeedingBird immediately of any unauthorized access or suspected breach. FeedingBird is not liable for any loss or damage resulting from your failure to secure your account.
By accessing or using the Services, you represent and warrant that you are at least eighteen (18) years of age, that you possess full legal capacity, authority, and competence to enter into a binding agreement, and that your use of the Services complies with these Terms and all applicable federal, state, and local laws and regulations. If you access or use the Services on behalf of another individual or entity, you represent and warrant that you have full legal authority to act for and bind such individual or entity. You further represent that all information you submit on behalf of such individual or entity is accurate, complete, and submitted with proper authorization. FeedingBird shall have no responsibility or liability for any claims, disputes, losses, or damages arising out of or related to your lack of authority, misrepresentation, or improper use of the Services on behalf of another person or entity. By using the Services in any representative capacity, you agree to indemnify and hold FeedingBird harmless from any claims arising from such use.
All content, features, software, interfaces, and materials available on or through the Site or Services, including text, graphics, logos, icons, images, audio, video, data, design elements, algorithms, documents, and the arrangement thereof, are owned by FeedingBird or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws. Except as expressly permitted in this Agreement, you obtain no ownership rights or licenses in any FeedingBird intellectual property by virtue of using the Services. FeedingBird's trademarks, including the name "FeedingBird" and all related logos and marks, may not be used without prior written permission. All rights not expressly granted herein are reserved by FeedingBird.
Subject to your full compliance with this Agreement, FeedingBird grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services for your personal estate-planning purposes or, if expressly authorized in writing by FeedingBird, for professional use on behalf of your clients. You may not reproduce, distribute, publicly display, create derivative works, reverse engineer, modify, or commercially exploit any aspect of the Site or Services unless explicitly authorized. Any unauthorized use automatically terminates the rights granted to you under this Agreement. FeedingBird offers certain products, features, and add-ons available for one-time purchase. All purchases are final. Except where required by applicable law, all sales are non-refundable once the purchase is completed and access to the relevant product or feature has been granted. If you believe you have been charged in error, please contact us at support@feedingbird.com within 30 days of the transaction. Payments are processed by third-party payment processors including Stripe and Apple Pay. FeedingBird does not store your full payment card details.
"User Content" refers to any information, documents, data, or materials uploaded, submitted, or provided by you through the Services. You retain ownership of your User Content, subject to the rights granted to FeedingBird herein. You grant FeedingBird a worldwide, royalty-free, transferable, sublicensable license to store, use, reproduce, modify, adapt, display, process, and create derivative works from your User Content as reasonably necessary to provide, maintain, analyse, and improve the Services; comply with legal obligations; or enforce this Agreement. You are solely responsible for ensuring the legality, accuracy, completeness, and appropriateness of your User Content, including ensuring that you have obtained all necessary rights, permissions, and consents from any third parties whose information you submit. FeedingBird may remove or disable access to any User Content at its sole discretion.
The Services may contain links or allow integrations with third-party websites, applications, or services ("Third-Party Services"). FeedingBird does not endorse, control, supervise, or guarantee any Third-Party Services and is not responsible for their actions, content, or privacy practices. Your use of any Third-Party Service is solely at your own risk and is governed by that service's own terms and policies. If FeedingBird facilitates access to attorneys, financial advisors, or other professionals, you acknowledge that such professionals are independent third parties and that FeedingBird does not supervise, guarantee, or assume responsibility for their services. No attorney-client relationship is created between you and FeedingBird.
You agree not to access or use the Site or Services for any unlawful, harmful, fraudulent, deceptive, abusive, or malicious purpose, or in any manner that violates this Agreement or applicable law. You further agree not to interfere with, disrupt, or impair the operation, security, or integrity of the Site or Services; attempt to gain unauthorized access to any systems, networks, data, or accounts; introduce viruses, malware, or other harmful code; misrepresent your identity or affiliation; engage in harassment, intimidation, or abusive conduct; or use any automated means, including bots, scrapers, or similar tools, to access or extract data from the Services without FeedingBird's prior written consent. FeedingBird reserves the right to investigate any suspected violation of this Agreement and to take any action it deems appropriate, including suspending or terminating your access, removing content, or restricting functionality, at any time and without prior notice. To the fullest extent permitted by law, FeedingBird shall have the right to pursue all available legal and equitable remedies, including filing legal proceedings, seeking injunctive relief, and recovering damages, costs, and reasonable attorneys' fees.
To the fullest extent permitted by law, the Site, Services, and all content, documents, and materials are provided "as is" and "as available," without any warranties of any kind, whether express, implied, or statutory. FeedingBird disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, and reliability. FeedingBird does not warrant that the services will operate without interruption, delays, errors, or security vulnerabilities. You acknowledge that you use the Services at your own risk, and you are solely responsible for determining whether any document or output is legally appropriate for your circumstances. Some jurisdictions do not allow limitations on certain implied warranties; in such cases, the above limitations apply only to the maximum extent permitted by law.
To the maximum extent permitted under applicable law, FeedingBird and its directors, officers, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, business interruption, or loss of goodwill, arising out of or related to your use or inability to use the site or services, whether based on contract, tort, negligence, strict liability, or any other theory, even if FeedingBird has been advised of the possibility of such damages. FeedingBird's total aggregate liability for any claim arising out of or related to the services or this agreement shall not exceed the greater of (a) the amount you paid to FeedingBird for the services in the six months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not permit the exclusion or limitation of certain damages; in such jurisdictions, FeedingBird's liability will be limited to the maximum extent allowed by law.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless FeedingBird, its officers, directors, employees, agents, contractors, affiliates, successors, and licensors from and against any and all claims, actions, proceedings, demands, liabilities, damages, losses, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the Site or Services, your User Content, your breach of any provision of this Agreement, your violation of any applicable law or regulation, your infringement or alleged infringement of any intellectual property or other rights of any third party, or any act or omission by you that results in a claim against FeedingBird. FeedingBird reserves the exclusive right, at its own expense, to assume the defence and control of any matter subject to indemnification by you, and you agree to cooperate fully with FeedingBird's defence of such claims.
You agree that prior to initiating any legal or arbitration claim, you will first attempt to resolve any dispute informally by contacting FeedingBird at support@FeedingBird.com and allowing at least thirty (30) days for FeedingBird to respond. Any dispute that cannot be resolved informally shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with the AAA's applicable rules. Arbitration shall be conducted before a single arbitrator in Bergen County, New Jersey. All arbitration proceedings shall be governed by the Federal Arbitration Act ("FAA"). You and FeedingBird agree that any dispute must be brought solely in your individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or mass action. You expressly waive any right to participate in or commence any class action, class arbitration, or other representative proceeding. You may opt out of the arbitration provisions of this Agreement by sending written notice to FeedingBird LLC, Attn: Arbitration Opt-Out, 200 Riverfront Blvd, Suite 104, Elmwood Park, NJ 07407, within thirty (30) days after first accepting these Terms.
Except to the extent pre-empted by federal law, this Agreement and any dispute between you and FeedingBird shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to principles of conflicts of law. Subject to the arbitration obligations described in Section 12, any legal action or proceeding relating to this Agreement or the Services shall be brought exclusively in the state or federal courts located in the State of New Jersey, and you hereby consent to the personal jurisdiction and venue of such courts. You agree that you shall not raise any objection to venue or jurisdiction based on forum non conveniens or any similar doctrine.
FeedingBird respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that content on the Site infringes your copyright, you may submit a DMCA notice to FeedingBird's Copyright Agent at the address provided in Section 20. Your notice must comply with the requirements set forth in 17 U.S.C. § 512(c)(3), including a physical or electronic signature, identification of the copyrighted work and infringing material, contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate. FeedingBird may remove or disable access to allegedly infringing material and may, in its discretion, terminate repeat infringers.
You represent and warrant that you will comply with all applicable U.S. export control laws, sanctions regulations, and restrictions issued by the U.S. Department of Commerce, U.S. Department of the Treasury, and other governmental authorities. You may not use, access, or export the Site or Services if you are located in a jurisdiction, or are identified on any list, where such use is prohibited under U.S. law. You further represent that you will not transfer, export, or provide access to any content or materials obtained through the Services in violation of applicable export control laws.
The Site and Services are not directed to children under thirteen (13) years of age, and children under thirteen are not permitted to use the Services. FeedingBird does not knowingly collect personal information from children under thirteen without legally required parental consent. If FeedingBird becomes aware that personal information from a child under thirteen has been collected in violation of applicable law, FeedingBird will take reasonable steps to delete such information, except to the extent that retention is required by law or necessary for FeedingBird's legitimate business operations, including where such information was submitted by a User as part of estate-planning activities.
FeedingBird may revise, update, or modify this Agreement at any time in its sole discretion. When changes are made, the "Last Updated" date will be revised accordingly, and FeedingBird may provide additional notice where required by law. Your continued use of the Site or Services after any changes become effective constitutes your acceptance of the modified Terms. If you do not agree to any updated Terms, you must immediately discontinue your use of the Site and Services.
FeedingBird may, in its sole discretion, suspend, restrict, or terminate your access to the Site or Services, in whole or in part, at any time, with or without notice, and for any reason or no reason, including without limitation any actual or suspected violation of this Agreement, fraudulent, unlawful, or abusive activity, or to address operational, technical, legal, or security concerns. Upon any suspension or termination, your right to access or use the Services shall immediately cease; however, termination shall not affect or limit any rights, remedies, or obligations that accrued prior to such termination. Without limitation, the following Sections shall expressly survive termination of this Agreement: Sections 4, 6, 9, 10, 11, 12, 13, 14, 19, and 20, together with any other provisions that, by their nature or express terms, are intended to survive termination.
This Agreement, together with the Privacy Policy and any supplemental terms presented in connection with specific Services, constitutes the entire agreement between you and FeedingBird concerning the subject matter herein and supersedes all prior or contemporaneous agreements or understandings. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any provision shall be deemed a continuing waiver or a waiver of any other provision unless expressly stated in writing. You may not assign or transfer any rights or obligations under this Agreement without FeedingBird's prior written consent. FeedingBird may assign this Agreement at any time to an affiliate or in connection with a merger, acquisition, corporate restructuring, or sale of assets. Section headings are for convenience only and have no legal effect.
This Agreement, together with the Privacy Policy and any supplemental terms presented in connection with specific Services, constitutes the entire agreement between you and FeedingBird concerning the subject matter herein and supersedes all prior or contemporaneous agreements or understandings. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. No waiver of any provision shall be deemed a continuing waiver or a waiver of any other provision unless expressly stated in writing. You may not assign or transfer any rights or obligations under this Agreement without FeedingBird's prior written consent. FeedingBird may assign this Agreement at any time to an affiliate or in connection with a merger, acquisition, corporate restructuring, or sale of assets.
