Do we each need separate documents?
A couple's trust covers both partners jointly. Each partner will still have their own pour-over will, power of attorney, and healthcare directive included in the plan.
What happens to the trust when one partner dies?
The surviving partner retains full control of the trust and all assets held within it. Upon the second partner's death, assets pass to the named beneficiaries.

What is the difference between a will and a living trust?
A will goes through probate (a public court process) before your assets are distributed. A trust transfers assets directly to your beneficiaries, bypassing probate entirely. Trusts also protect your privacy since they never become public record. Many people have both.
Is a FeedingBird trust legally valid?

What assets can I put in my trust?
You can include real estate, bank accounts, investment accounts, vehicles, and personal property. Assets like retirement accounts and life insurance policies cannot go into a trust because they already have designated beneficiaries, but your trust can be named as the beneficiary.
What is a living trust, and do I need one?
A living trust is a legal document that lets you transfer your assets to a trustee (usually yourself) to manage during your lifetime and distribute to your beneficiaries after you die, without going through probate. It is a good fit if you own real estate, have significant assets, or want to avoid the cost and delay of probate court.
Do I need a notary to sign my trust?
Yes. A living trust must be signed in front of a notary public to be legally valid. FeedingBird walks you through exactly what is required in your state.
Can I change my trust after I create it?
Yes. A FeedingBird revocable living trust can be amended at any time. Unlimited lifetime updates are included with your plan.

Do I need a lawyer to make a will?
No. Most people don't need a lawyer for a straightforward will. FeedingBird guides you through the entire process, from naming beneficiaries to choosing an executor and designating guardians for minor children. If you'd like professional review, Attorney Support is available as an add-on.
What happens if I die without a will?
Your state decides how your assets are distributed through a process called intestate succession. Assets may not go to the people you intended, and courts may appoint a guardian for your children rather than someone you would have chosen.
What is an executor, and who should I choose?
An executor is the person responsible for carrying out your will, paying debts, filing taxes, and distributing assets to your beneficiaries. Choose someone organized and trustworthy. A spouse, adult child, or close friend are common choices.
Can I name a guardian for my children in my will?
Yes. Your will is the legal document that lets you designate your preferred guardian for minor children. Without one, a court makes that decision.
How is a will different from a trust?
A will takes effect only after you die and goes through probate court. A trust takes effect immediately, avoids probate, and can also protect you during incapacity. Many people have both — a trust for major assets and a pour-over will as a safety net.
